Purchase Terms
The Effective Date of these Purchase Terms and Conditions is March 1, 2011.
These Purchase Terms are Additional Terms, as defined in the Justice Terms of Use. Terms of Use and together with the Terms of Use apply to your purchase of a service or product offered via the Tween Channels, as that term is defined in the Terms of Use, to your purchases through our catalog, and (as applicable) to your purchases in our U.S. retail locations. Your purchase from us constitutes your agreement to follow these Purchase Terms and Terms of Use and to be bound by them. IF YOU DO NOT AGREE, PLEASE DO NOT PURCHASE FROM US. Please also review the Justice and Brothers Privacy Policy.
Merchandise Availability
Since we offer the latest in fashion, we may sell out of some items faster than others, and once they are gone, they may be gone for good. We do not offer rain checks.
Justice and Brothers may, at our own discretion, limit or cancel quantities purchased per person, per household or per order. We also reserve the right to refuse any order you place with us. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to an order, we will attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit sales to dealers, resellers or distributors.
Backordered Items
Backordered items are temporarily out of stock. In-stock items will ship at the time the order is placed. Backordered items will be shipped via Standard Delivery at no additional charge if they become available.
Pricing
The prices displayed are quoted in U.S. Dollars and are valid and effective only in the U.S.
From time to time there may be information on the Tween Channels or in our catalog that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. Justice and Brothers reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice to you (including after you have submitted your order).
A one-time price adjustment may be conducted when accompanied by the original sales receipt within 14 days from the date of purchase. Promotional offers are not valid on previously purchased merchandise. Promotional offers may include, but are not limited to, J-Bucks, Fun Cards and Super Saver Cards.
Unless otherwise stated on the coupons, discounts cannot be combined with any other offers, discounts or promotional programs, except markdowns. Detailed information about our coupon promotions can be found here.
Sales Tax
Sales tax is currently collected on ALL purchases made in a Justice retail store, through a Justice catalog or through the Justice or Brothers websites with the exception of the following. "Non-essentials" (as noted in the exceptions below) refer to jewelry, accessories, room stuff, cosmetics and toiletry items offered by Justice and Brothers.
- Justice and Brothers currently do not have retail stores in the following states: Alaska, District of Columbia, Hawaii, Montana, and Wyoming. Therefore, Justice does not collect taxes on website and catalog purchases that are shipped to these states.
- The following states do not currently have a sales tax on clothing and non-essentials offered by Justice and Brothers: Delaware, New Hampshire, Montana, Alaska and Oregon. Hence, there is no sales tax applied to retail purchases made in these states or on catalog orders shipped to these states.

The following states exempt sales tax on clothing and footwear purchased in Justice retail stores or on orders shipped to these states: Massachusetts,
Minnesota, New Jersey, Pennsylvania, Rhode Island, Connecticut, New York, and Vermont.
- Not all counties in New York exempt clothing; therefore depending on the ship to location, we may still be required to collect county sales tax because we have a physical store location in that county.
- Clothing items purchased in Massachusetts must have a unit retail price less than $175 to be tax exempt. Connecticut-purchased items must be less than $50 per unit and items purchased in (or shipped to) New York and Vermont must have a unit retail price less than $110 to be tax exempt. There is no dollar limit to the exemption in Vermont.
Shipping & Handling Rates
Shipping and handling charges are assessed on all orders based on the merchandise total after discounts and before taxes. When gift cards are purchased with merchandise, your gift cards will be shipped separately with your merchandise at no additional cost.

Standard Service
Orders usually arrive within 4-7 business days (for in-stock items only).
3rd Business Day Service
- With 3rd Business Day Service, orders will be delivered within 3 business days if they are placed by 2 P.M. EST Monday - Friday, excluding U.S. holidays.
- Orders placed on Friday after 2 P.M. EST and over the weekend will be shipped on Monday, excluding U.S. holidays.
- 3rd Business Day Service is not available for addresses with P.O. Boxes, APO/FPO, U.S. Territories, Alaska, Hawaii and some rural areas of the U.S.
Next Business Day Service
- With Next Business Day Service, orders will be delivered on the next business day if they are placed by 2 P.M. EST Monday - Friday, excluding U.S. holidays.
- Orders placed on Friday after 2 P.M. EST and over the weekend will be shipped on Monday, excluding U.S. holidays.
- Next Business Day Delivery Service is not available on Saturdays, Sundays, and some U.S. holidays.
- Next Business Day Delivery Service is not available for addresses with P.O. Boxes, APO/FPO, U.S. Territories, Alaska, Hawaii and some rural areas of the U.S.
- A signature may be required for delivery.
- Some rural areas of the U.S. may take up to 2 business days for delivery with Next Business Day Service.
Additional Shipping Charges
Additional shipping charges may apply to some items (e.g. room decor) because of size, weight or special handling that is required to make sure your order reaches you safely. If your item has an additional shipping charge, it will appear in the description area of the item on the product page.

Gift Cards Purchased With Merchandise
When gift cards are purchased with merchandise, they will be shipped separately with your merchandise at no additional cost.
Gift Card Only Orders
- A $1.00 shipping and handling charge will be assessed for any gift card purchased without merchandise and shipped by Standard Service within the U.S.
- Gift cards may be sent 3rd Business Day for $15.00
- Gift cards may be sent Next Business Day for $19.00

A $15.00 shipping and handling charge will be assessed for any gift card purchased and shipped to Canada without merchandise.

When gift cards are purchased with merchandise, they will be shipped separately with your merchandise at no additional cost.
Gift Card Only Orders
A $20.00 shipping and handling charge will be assessed for any gift card purchased and shipped without merchandise.
Payment Information
We accept the following forms of payment for online, phone and fax orders:
- Major credit cards (Visa, MasterCard, Discover, American Express, and Diner's Club)
- Justice credit cards
- Justice and Brothers Gift Cards and eGift cards
- PayPal (online only)
Orders will be processed and shipped pending credit card authorization. When you place an order, we will pre-authorize your credit card to ensure the funds are available. If you are using MasterCard or Visa, or potentially other cards, the pre-authorization may appear as if you have been charged. With some institutions' cards, the funds become unavailable, but the account is not debited until the order ships.
If you are using a debit card we will request authorization from your bank for the transaction when your order is submitted. Your bank will place a hold on these funds in anticipation of receiving the actual withdrawal from your deposit account. We do not process the actual charge to your debit card until your order is shipped; however, we will request another authorization from your bank to verify that the funds remain available if there is a delay from your order date to our shipping date.
If the order is canceled for any reason, the time it takes for the hold to release depends on the issuer of the card and is not within our control.
United States Store Purchases
We accept the following forms of payment in the U.S.:
- Major credit cards (Visa, MasterCard, Discover, American Express, and Diner's Club)
- Cash
- Justice, Brothers or Limited Too gift cards and eGift cards
- Merchandise credits
Personal Check Guidelines in U.S. Justice and Brothers Stores
- Justice and Brothers stores in the U.S. will gladly accept personal checks pre-printed with your name, address and account number. A photo or military identification is required for verification.
- Your current address and daytime phone number may be requested for verification. Justice and Brothers reserve the right to verify funds with your bank and can refuse any check not meeting our check acceptance policy.
- Returned checks are subject to a service charge of $20 or the maximum allowed by law. Collection costs and all penalties permitted by law will also be assessed. We may electronically collect returned checks, service charges and other applicable charges.
- When returning items purchased by personal check, there is a 10-day waiting period before cash can be refunded.
Returns & Exchanges
We will gladly accept returns of unwashed, unworn, or defective Justice or Brothers merchandise at any of our stores in the United States or Puerto Rico within 90 days of the original purchase date. When you have an original sales receipt/invoice, refunds will be provided in the manner in which the original purchase was made, except where the original purchase was made online using PayPal. Merchandise purchased using PayPal and returned to stores with the invoice will be issued a merchandise credit certificate for the purchase price. Without an original sales receipt/invoice, we will extend a merchandise credit certificate for the current selling price of the returned merchandise.
We reserve the right to verify original purchase and to ask for identification for returns made without a receipt. Gift receipts and exchange receipts may only be used to receive a merchandise credit certificate or merchandise exchange for the price indicated on the receipt.
A 10-day waiting period is required before customers having purchased by check will be given a refund. Discounts given at the time of purchase will be deducted from returned merchandise. In the event of a return or exchange, discount will be forfeited and may not be reused.
Web & Catalog Returns
Unwashed, unworn, or defective merchandise purchased through our catalog or websites may be returned to stores under the "Returns and Exchanges" Policy above, or may be returned by mail within 90 days of the original purchase date to the Return Center listed below, following the instructions on the invoice. Refunds on returns to the Return Center will be provided in the manner in which the original purchase was made.
Address labels are provided. If you choose not to use the label provided or are ineligible for our free returns offer, you must prepay postage at the point of return. We cannot accept cash on delivery packages. Shipping and handling are nonrefundable.
There are three options to return your web or catalog purchase:
Option 1: Easy Free Returns using the pre-addressed label
Justice and Brothers offer one free return label for each online order. Simply affix the Return Label on the front of the invoice to the package and send via U.S. Postal Service (Not vaild on purchases made in Justice and Brothers stores.) Please remove any previous labels or tape from the original package. The return label cannot be used for returns from AK, HI, or outside the United States.
Option 2: Return to a store near you
You may return Justice and Brothers items purchased from the catalog or website at any Justice or Justice and Brothers store in the United States or Puerto Rico. Be sure to take your invoice with you.
Option 3: Return by mail on your own
You must prepay postage at the point of return. We cannot accept cash on delivery packages. Shipping and handling are nonrefundable.

Merchandise Credit Terms & Conditions
- Merchandise Credits may be redeemed for merchandise only and cannot be used online.
- Merchandise Credits are not redeemable for cash under any circumstance.
- Merchandise Credit Certificates cannot be replaced if lost or stolen.
